Quebec lifts the suspension of procedural delays

After four and a half months of judicial limbo, the justice Minister of Quebec finally announced yesterday that the suspension of the judicial, procedural and prescription delays will be lifted as of September 1, 2020. In this much anticipated announcement, the minister also grants a 45 day extension to all procedural delays, namely case protocol and inscription delays, effectively extending such delays by a total period of 7 months (5 and a half months of suspension plus 45 days).

Although the announcement does not address it explicitly, it is to be understood that the 45 day extension will not apply to prescription and forfeiture delays. Added vigilance is, therefore, strongly advised for those who were facing an imminent expiry of their right to take legal action shortly after March 15, 2020.
