Droit inc. – The Notary’s Role in Québec Real Estate: How Neutrality Protects Every Party
Our recent article, Le rôle du notaire en immobilier au Québec : comment la neutralité protège toutes les parties, authored by Lynn Wazzan, was republished by Droit inc. (Available in French only).
In this article, the author explains the unique role of the notary in Québec real estate transactions—as both a legal advisor and a public officer. This dual function ensures impartiality and legal certainty for all parties involved, including buyers, sellers, and lenders.
The article explores how the notary’s neutrality protects each party’s rights: the lender obtains a valid and enforceable hypothec, the buyer receives a clear title, and the seller obtains proper payment and discharge. It also clarifies the limits of this impartiality, which does not extend to external participants such as brokers or co-ownership syndicates.
The author also highlights the importance of the authentic deed (acte authentique), which provides the highest evidentiary value under the Civil Code of Québec. This formality guarantees enforceability before the courts and ensures that every signatory’s rights are recognized equally.
